Terms of Service

1. Who we are

Kurir.express is a marketplace that connects clients who need a parcel delivered with independent couriers and local delivery companies who carry it. We do not employ couriers and we are not a party to the delivery contract between a client and a courier — we provide the technology that matches them, calculates the price, and settles the platform fee.

2. Services

EXPRESS — same-city, on-demand delivery, offered to nearby couriers in real time.

STANDARD — intercity delivery consolidated onto scheduled courier routes.

Both services may include live tracking, proof of delivery, and cash-on-delivery (COD) collection where the assigned courier accepts that payment method.

3. Placing an order

A contract for delivery is formed at the moment a courier accepts your order (either at the platform price or at a counter-price you accept). Where a courier offers a higher price, you decide whether to accept it before the order is theirs — nothing is charged without your approval. The price you approve is the price you pay; the platform does not add fees on top of what is displayed.

You are responsible for providing an accurate pickup and drop-off location, an honest description of the parcel, and for not shipping anything on the prohibited list below.

4. Prohibited items

You may not ship: weapons and ammunition; illegal drugs or precursors; hazardous, flammable, corrosive, or radioactive material; live animals; cash, securities, or bearer instruments; court or postal documents restricted by law; or any item whose carriage is prohibited under applicable Montenegrin or regional law. We and the courier may refuse or inspect a parcel we reasonably suspect violates this clause.

5. Pricing and payment

Prices are set by the platform per service and country, and are shown to you before you confirm the order; depending on the service, they may factor in road distance, parcel weight, and vehicle type, or be a flat rate regardless of distance. Couriers may offer a different price — lower, or higher through the in-app bidding flow — and you always see and approve the final price before it applies.

Cash on delivery: the courier collects payment from the recipient and settles with the sender directly. The platform is not a party to that payment and does not hold client funds on the COD leg.

The platform does not charge clients for deliveries and does not take payment from you. You pay the courier directly, by the method you and the courier agreed — cash, card, transfer, or QR. The only money the platform collects is its fee, and it collects that from the courier, out of a balance the courier has topped up in advance, and only for a delivery that was completed.

Card details are never stored by us. During this pilot phase, couriers top up their balance directly with us (bank transfer or another method our team arranges with them) rather than through an automated card checkout. Once card top-ups go live, they will run through a licensed payment service provider and we will still retain only a payment token and the last four digits — never a full card number. Clients have no card on file with us, now or once that changes.

6. Delivery times

Any pickup/delivery estimate shown in the app is an estimate calculated from live conditions, not a guaranteed delivery window, unless a specific service-level agreement has been separately agreed in writing for a business account.

7. Liability

Our liability for loss or damage to a parcel carried through the platform is limited as set out in the applicable courier terms and, where relevant, mandatory provisions of the Zakon o poštanskim uslugama (Postal Services Act) of Montenegro. Declaring a higher parcel value may entitle you to extended coverage where offered. We are not liable for indirect or consequential loss, or for delays caused by events beyond reasonable control (force majeure), including weather, traffic restrictions, or public authority action.

8. Complaints

If something goes wrong, contact us at [email protected] with your order code. We aim to acknowledge complaints promptly and resolve them within the timeframe required by applicable consumer-protection law. Unresolved regulatory complaints may be escalated to EKIP (Agencija za elektronske komunikacije i poštansku djelatnost Crne Gore).

9. Couriers

Couriers operate as independent contractors or through their own registered business/entrepreneur status — not as employees of the platform. Couriers set the zones, vehicle, and payment methods they accept, and may accept, decline, or counter-offer any order. The platform charges a fixed fee for each completed order, deducted from the courier's prepaid balance only once the delivery is done; the amount is shown in the app before the courier goes online and may differ by country.

10. Proof of delivery

Delivery is confirmed by a courier-submitted photo or PIN code at the drop-off location, verified against the delivery address. These records, together with the order status history, are treated as evidence of delivery for the purposes of resolving disputes.

11. Changes, governing law, disputes

We may update these Terms from time to time; material changes will be highlighted in the app. Continued use after a change constitutes acceptance. These Terms are governed by the law of Montenegro, and the courts of Podgorica have exclusive jurisdiction, without prejudice to any mandatory consumer-protection rights you have in your country of residence.
